The only way to really get this done is to somehow convince him to attack you. It is a specialty of off-duty cops in a bar and I've seen it done many times.
He'd have to confront the suspect and quiz him on things while simultaneously getting him riled enough to attack him. Because if there is someone beat up on the floor, it won't take the cops long to figure out what is up and start charging Brett with everything from menacing to aggravated assault to terroristic threats. These all suck to be charged with.
If you do confront him, record everything. In most states, the wire tap laws only need the consent of one of the parties in a recording. One of those people can be YOU (it is illegal to record OTHER people talking to OTHER people). Your word vs his word becomes so much more awesome when it is your MPEG vs his word.
